What is Small Claims Court?

 

The Small Claims Court is a branch of the Superior Court of Justice and manages nearly half of all civil claims in the province of Ontario. You may claim a maximum monetary amount of up to $35,000. This Court provides an efficient and cost-effective forum for Ontarians to initiate and defend one’s case. You may wish to consider this court even if you have a claim that is greater than $35,000.00 if you are willing to waive the excess amount to avoid costly litigation.

 

 

Common Claims Include:

  • Breach of contract
  • Goods or services sold and delivered but weren’t paid for
  • Unpaid loans or debts
  • Unpaid residential or commercial rent
  • NSF (non-sufficient funds) cheques
  • Property damage
  • Personal injuries
